Equal Credit Opportunity Act Disclosure
In accordance with the Equal Credit Opportunity Act, Aspire Home Loans LLC does not discriminate against any applicant on the basis of race, color, religion, creed, national origin, ancestry, sex, marital status, familial status, sexual orientation, age (provided the applicant has the capacity to enter into a binding agreement), medical history, disability, physical condition, military status, because the applicant has in good faith exercised any right under the Consumer Credit Protection Act or the Servicemembers Civil Relief Act (SCRA), because all or part of the applicant’s income derives from a public assistance program, or on any other basis prohibited by applicable law.
Marketing and Advertising Records Retention
Aspire Home Loans LLC maintains books, records, and materials relating to its advertising, marketing, solicitation, mortgage loan origination communications, and related compliance activities. These records may include, without limitation, website content, landing pages, social media posts, digital advertisements, printed advertisements, lead forms, disclosures, email campaigns, marketing correspondence, and other consumer-facing promotional materials.
All such records are retained for a minimum of six (6) years from the date the record is created or last used, whichever is later, unless a longer retention period is required by applicable law, regulation, examination request, litigation hold, or governmental inquiry. Records are maintained in a manner reasonably designed to support compliance monitoring, complaint review, audit readiness, and regulatory examination.
Texas Complaints and Recovery Fund Notice
A mortgage company or its sponsored originator must post in a conspicuous manner the notice required by 7 Tex. Admin. Code § 81.200(b) on each website and social media site of the mortgage company or sponsored originator that is accessible by a mortgage applicant or prospective mortgage applicant and either used to conduct residential mortgage loan origination business or used to advertise or solicit such business.
A mortgage company must provide the following information on all correspondence sent to mortgage applicants:

The name of the mortgage company, followed by the mortgage company’s NMLS number; and

If the correspondence is from the sponsored originator, the name of the sponsored originator, followed by the sponsored originator’s NMLS number.

THE DEPARTMENT MAINTAINS A RECOVERY FUND TO MAKE PAYMENTS OF CERTAIN ACTUAL OUT-OF-POCKET DAMAGES SUSTAINED BY BORROWERS CAUSED BY ACTS OF LICENSED MORTGAGE COMPANY RESIDENTIAL MORTGAGE LOAN ORIGINATORS. A WRITTEN APPLICATION FOR REIMBURSEMENT FROM THE RECOVERY FUND MUST BE FILED WITH AND INVESTIGATED BY THE DEPARTMENT PRIOR TO PAYMENT OF A CLAIM.
